Who Is Governing Delta? How Council Shifted Public Decisions to Administration—and Why Residents Should Pay Attention

Delta Council adopted major delegation bylaws after the 2022 election. Those bylaws transferred defined Council powers to senior administration—but did Council create enough public reporting, monitoring, and review?
Delta residents elect a mayor and six councilors to govern the municipality, study legislation, question recommendations, make decisions, and remain publicly accountable.
Professional staff are essential. They provide technical, legal, financial and planning expertise that elected officials require. But administrative expertise cannot replace democratic responsibility.
Since the present Council was elected in October 2022, it has adopted a series of bylaws that transferred significant operational, financial, and development-related authority from public Council meetings to senior City officials.
The City described these changes as modernization and streamlining. Efficiency is a legitimate objective—but it cannot be the only measure of good government.
The central question is:
What public reporting, monitoring, and review safeguards did Council establish so residents can see how these delegated powers are being exercised?
The Timeline: When Council Adopted the Bylaws

This was not one isolated decision. It was a sequence of governance changes adopted during the present Council term.
What Bylaw 8199 Transferred
Delegation of Authority Bylaw No. 8199 transferred defined operational, contractual, legal, financial, and development-related powers to City employees and senior administrative positions.
Among other things, the bylaw authorized:
- Department heads to approve certain operational agreements with values generally up to $250,000.
- The City Manager and Director of Finance, acting together, to approve certain agreements up to $500,000.
- The City Manager to authorize legal proceedings with estimated values up to $500,000.
- Certain officials to settle claims within specified financial limits.
- The planning head to negotiate development-related covenants, statutory rights-of-way and other documents.
- The planning head to exercise discretion over the amount and type of development securities.
- The release or minor modification of certain covenants and rights-of-way.
- Members of the Staff Leadership Team to sub-delegate portions of their authority to supervised employees.
Bylaw 8199 did not transfer all of Council’s authority. Council retained its lawmaking functions and powers that legislation prohibits it from delegating.
Nevertheless, it placed substantial day-to-day decision-making authority in senior administrative offices.
Council adopted the bylaw unanimously on January 9, 2023. The final-adoption motion was moved by Councilor Daniel Boisvert and seconded by Councilor Alicia Guichon. The official January 9, 2023 Council minutes record the vote.

What Bylaw 8347 Added
Development Application Procedures Bylaw No. 8347 expanded the development system.
It delegated specified “powers, duties and functions of Council” to the General Manager responsible for development applications.
Those delegated powers included authority to:
- Decide whether to hold a public hearing for a proposed rezoning consistent with the Official Community Plan.
- Issue or amend development permits where no variances—or only minor variances—are requested.
- Issue, amend, or renew temporary-use permits.
- Approve certain extensions after third reading of rezoning applications.
- Issue minor development-variance permits.
- Consider variances involving setbacks, building height, lot coverage, parking, loading, screening and landscaping.
- Require development securities.
- Prescribe application forms and supporting information.
- Require technical studies and development-approval information.
- Enter into or amend covenants, statutory rights-of-way and easements when required as development conditions.
- Execute permits and other development documents.
- Decide whether a delegated matter should instead be returned to Council because of complexity, public interest or another circumstance.
The City’s November 6, 2023 report said the purpose was to modernize the application process, accelerate development and support provincial housing initiatives.
The same report records that City staff consulted the Urban Development Institute, which supported the proposed streamlining measures.
The report does not identify a comparable consultation with residents, neighborhood associations, or an independent public-interest organization before the expanded authority was approved.
That raises a fair question:
Before transferring more development authority to administration, why was a development-industry organization consulted while no comparable resident consultation was identified?
The official report and proposed Bylaw 8347 set out the expanded staff authority.
Who Initially Exercised the Development Authority?
When Bylaw 8347 was adopted on December 4, 2023, Doreann Mayhew was Delta’s General Manager, Development.
Ms. Mayhew signed the staff report recommending adoption of the new bylaw. As General Manager, Development, her office administered the Development Department, advised Council and exercised the powers delegated to the General Manager.
This should not be misrepresented. Ms. Mayhew did not become an elected councilor and did not receive all of Council’s responsibilities.
However, her office was performing two connected functions:
- Advising Council as the administrative head of the Development Department.
- Exercising specific Council powers delegated through Bylaw 8347.
By 2026, Ms. Mayhew had moved to General Manager, Facilities and Major Projects. Because the authority is assigned to the development position—not to her personally—the powers would follow the position or successor responsible for development applications.
The issue is therefore institutional, not personal.
Residents should be told:
- Who currently holds the delegated development authority?
- Which powers are exercised directly by the General Manager?
- Which powers have been further assigned to other employees?
- How many decisions have been made under each delegated provision?
- How does Council monitor those decisions?
Is There a Review Process?
Bylaw 8347 does contain one important safeguard.
An applicant may request that Council reconsider a delegated decision within 14 days of receiving written notice. The request is made to the City Clerk; the delegate must prepare a written explanation, and the reconsideration must be placed before Council as soon as reasonably possible.
That safeguard should be acknowledged.
But it is limited:
- It appears to protect the development applicant—not necessarily neighbors or other affected residents.
- The applicant has only 14 days to act.
- It operates only after the applicant receives written notice.
- It does not create a comprehensive public register of delegated decisions.
- It does not require publication of every decision and the reasons supporting it.
- It does not provide residents with regular statistics showing how the authority is being exercised.
A limited reconsideration procedure is not the same thing as continuous public oversight.
Where Is the Mandatory Public Reporting?
Neither Bylaw 8199 nor Bylaw 8347 appears to require a comprehensive annual public report identifying every exercise of the delegated powers.
The bylaws do not appear to require publication of:
- Every delegated approval or refusal.
- Every development permit approved administratively.
- Every minor variance granted or refused.
- Every extension approved.
- Every covenant or statutory right-of-way negotiated, amended or released.
- Every security amount determined or adjusted.
- Every decision not to hold a public hearing.
- Every power sub-delegated to another employee.
- The written reasons supporting every decision.
- Statistics showing how frequently each delegated power was exercised.
- A regular independent audit of the consistency of those decisions.
The absence of mandatory reporting does not prove that any employee acted improperly.
It means residents may lack the information required to determine whether the powers were exercised consistently, fairly, and within Council’s intended limits.
That is the accountability gap.
Public Notice Was Also Reduced
Council later amended Bylaw 8347.
On October 21, 2024, Council unanimously adopted Amendment Bylaw No. 8443. The amendment removed the requirement to provide mailed notice to surrounding owners and tenants before the General Manager considered delegated minor-development-variance applications.
The City said the amendment would align Delta’s procedures with the Local Government Act and reduce processing time.
On November 18, 2024, Council adopted Amendment Bylaw No. 8451. It allowed the General Manager, Development, to alter or entirely waive application-sign requirements for certain small-scale multi-unit housing rezoning applications consistent with the OCP.
Again, the stated purpose was streamlining.
But streamlining can have a public cost when administrative authority expands while notice, visibility, and reporting decrease.
Provincial Housing Legislation Did Not Remove Council’s Responsibility
Provincial housing initiatives pressured municipalities to accelerate housing approvals.
Bill 44 required local governments to permit prescribed forms of small-scale multi-unit housing. Bill 25 later addressed municipal rules and barriers that could frustrate those permissions.
But provincial housing legislation did not require Delta Council to surrender its oversight responsibilities.
Council could rely on staff to draft bylaws, process applications and provide professional advice. Elected officials nevertheless remained responsible for determining whether Delta’s bylaws complied with provincial requirements both technically and practically.
That includes examining whether existing comprehensive-development zones, lot coverage limits, setbacks, height restrictions, parking rules, access requirements and other municipal conditions continue to prevent the housing capacity contemplated by provincial legislation.
Council cannot answer those concerns merely by saying staff advised that Delta was compliant.
Elected officials are expected to study the issue, question the analysis, and explain their conclusions publicly.
The Next Concern: Who Controls Access to Council?
The governance concern does not end with development decisions.
Council Procedure Bylaw No. 8330 governs requests from residents and organizations seeking to appear before Council as delegations.
In a written response provided to DCC Now concerning Bylaw 8330, One Delta supported having the Corporate Officer approve delegation requests.
Delta residents do not elect the Corporate Officer. The position is appointed.
Administrative staff can reasonably check whether a request is complete, schedule an appearance, and enforce neutral procedural requirements. But giving an unelected officer final authority to decide which residents may address their elected Council raises a much larger democratic question.
If the Corporate Officer can refuse a delegation request:
- Must the refusal cite the exact provision of Bylaw 8330?
- Must written reasons be provided?
- Can the resident appeal directly to Council?
- Are councilors informed that the request was received and refused?
- Is the request preserved as a municipal record?
- Is there a public register of approvals and refusals?
- Does Council receive annual statistics?
- How can Council know which residents are being prevented from appearing before it?
One Delta says it wants to strengthen community engagement and ensure every voice is heard at City Hall.
Its position should therefore be explained clearly:
Would the Corporate Officer merely administer delegation requests under objective rules, or would the officer possess final discretion to prevent residents from appearing before Council?
Without written reasons, public records, and an appeal to Council, administrative screening becomes administrative gatekeeping.
Council Cannot Blame “Staff Decisions”
Council:
- Adopted Bylaws 8199, 8330 and 8347.
- Selected the offices receiving delegated authority.
- Established the scope of the powers.
- Approved the absence of a comprehensive reporting requirement.
- Can require regular reports.
- Can review how the system operates.
- Can amend or repeal the bylaws.
- Remains accountable to voters.
Council therefore cannot completely distance itself from a disputed decision by describing it as a staff matter.
If Council created the authority, retained the power to supervise it, and allowed the system to continue, Council remains politically responsible for how that system operates.
This Is Not About Eliminating Professional Staff
No responsible municipality can operate without qualified planners, engineers, lawyers, financial officers, administrators and other employees.
The issue is balance.
A functioning democratic structure should operate this way:
- Residents elect Council.
- Council adopts laws, policies and budgets.
- Council delegates clearly defined administrative work.
- Staff implement Council’s direction.
- Delegated decisions are recorded and reported.
- Affected people receive written reasons and meaningful review rights.
- Council monitors the system and remains accountable.
The democratic loop weakens when:
- Council delegates consequential authority.
- Decisions move outside public Council agendas.
- Public notice is reduced.
- No comprehensive decision register is published.
- Residents cannot obtain clear reasons.
- Access to Council is controlled administratively.
- Elected officials describe the resulting disputes as staff matters.
That system may still be legally municipal, but it becomes democratically remote.
Questions Delta Council Should Answer
DCC Now is asking Delta Council to answer the following:
- Who currently exercises the powers delegated to the General Manager, Development under Bylaws 8199 and 8347?
- Which of those powers have been sub-delegated to other employees?
- How many decisions have been made under each delegated provision since January 9, 2023?
- How many applications were approved, refused, extended, modified, or referred to Council?
- What written reports concerning those decisions have been provided to Council?
- Why do the bylaws not require a comprehensive annual public report?
- Will Council establish a publicly searchable delegated-decision register?
- Will Council require the publication of written reasons for significant administrative decisions?
- What review rights exist for neighbors and residents affected by a delegated development decision?
- Will Council publish every delegation request submitted under Bylaw 8330, together with the decision and reasons?
- Will residents refused permission to appear have a direct right of appeal to Council?
- Will One Delta clarify whether its proposal gives the Corporate Officer final authority to approve and refuse delegation requests?
The Strongest Public Conclusion
Delta still has an elected municipal government. But since the present Council was elected, it has transferred substantial operational and development-related authority to unelected administration while failing to require a comprehensive public record of how those powers are exercised.
Delegation can improve efficiency. It can also reduce transparency when decisions disappear from public agendas, public notice is reduced, and no annual reporting system allows residents to follow what happened.
Residents do not elect senior staff. They elect a mayor and six councilors to govern, exercise due diligence, question administration, listen to the public, and remain accountable.
Staff should administer the City. They should not become a substitute for elected oversight—and they should not control residents’ access to elected representatives without objective rules, written reasons, complete records, and a meaningful right of appeal.
Council created this system. Council can review it. Council can correct it. Council remains responsible for it.
The final question for every Delta voter is:
If consequential decisions are made administratively, the public cannot see a complete record, and an appointed officer can decide which residents may address Council, where does democratic accountability actually reside?

| 18 ਨਵੰਬਰ 2024 | ਕੌਂਸਲ ਨੇ ਉਪਨਿਯਮ 8451 ਨੂੰ ਅੰਤਿਮ ਮਨਜ਼ੂਰੀ ਦਿੱਤੀ, ਜਿਸ ਨਾਲ ਵਿਕਾਸ ਮਹਾਂਪ੍ਰਬੰਧਕ ਨੂੰ ਕੁਝ ਛੋਟੇ ਪੱਧਰ ਦੇ ਬਹੁ-ਇਕਾਈ ਰਿਹਾਇਸ਼ੀ ਮੁੜ-ਜ਼ੋਨਿੰਗ ਮਾਮਲਿਆਂ ਵਿੱਚ ਅਰਜ਼ੀ ਸੂਚਨਾ-ਪਟ ਦੀ ਸ਼ਰਤ ਬਦਲਣ ਜਾਂ ਪੂਰੀ ਤਰ੍ਹਾਂ ਮੁਆਫ਼ ਕਰਨ ਦਾ ਅਧਿਕਾਰ ਮਿਲਿਆ। |
ਇਹ ਕੋਈ ਇਕੱਲਾ ਫ਼ੈਸਲਾ ਨਹੀਂ ਸੀ। ਇਹ ਮੌਜੂਦਾ ਕੌਂਸਲ ਦੇ ਕਾਰਜਕਾਲ ਦੌਰਾਨ ਅਪਣਾਈਆਂ ਗਈਆਂ ਸ਼ਾਸਕੀ ਤਬਦੀਲੀਆਂ ਦੀ ਲੜੀ ਸੀ।
ਉਪਨਿਯਮ 8199 ਨੇ ਕੀ ਸੌਂਪਿਆ?
ਅਧਿਕਾਰ ਸੌਂਪਣ ਉਪਨਿਯਮ ਨੰਬਰ 8199 ਨੇ ਨਿਰਧਾਰਤ ਕਾਰਜਕਾਰੀ, ਠੇਕਾ-ਸੰਬੰਧੀ, ਕਾਨੂੰਨੀ, ਵਿੱਤੀ ਅਤੇ ਵਿਕਾਸ ਅਧਿਕਾਰ ਨਗਰ ਕਰਮਚਾਰੀਆਂ ਅਤੇ ਸੀਨੀਅਰ ਪ੍ਰਸ਼ਾਸਕੀ ਅਹੁਦਿਆਂ ਨੂੰ ਸੌਂਪੇ।
ਹੋਰ ਗੱਲਾਂ ਦੇ ਨਾਲ, ਇਸ ਉਪਨਿਯਮ ਨੇ ਹੇਠ ਲਿਖੇ ਅਧਿਕਾਰ ਦਿੱਤੇ:
- ਵਿਭਾਗ ਮੁਖੀਆਂ ਨੂੰ ਆਮ ਤੌਰ ਉੱਤੇ 250,000 ਡਾਲਰ ਤੱਕ ਦੇ ਕੁਝ ਕਾਰਜਕਾਰੀ ਸਮਝੌਤੇ ਮਨਜ਼ੂਰ ਕਰਨੇ।
- ਨਗਰ ਪ੍ਰਬੰਧਕ ਅਤੇ ਵਿੱਤ ਨਿਰਦੇਸ਼ਕ ਨੂੰ ਇਕੱਠੇ 500,000 ਡਾਲਰ ਤੱਕ ਦੇ ਕੁਝ ਸਮਝੌਤੇ ਮਨਜ਼ੂਰ ਕਰਨੇ।
- ਨਗਰ ਪ੍ਰਬੰਧਕ ਨੂੰ 500,000 ਡਾਲਰ ਤੱਕ ਦੀ ਅੰਦਾਜ਼ਨ ਕੀਮਤ ਵਾਲੀ ਕਾਨੂੰਨੀ ਕਾਰਵਾਈ ਅਧਿਕਾਰਤ ਕਰਨੀ।
- ਨਿਰਧਾਰਤ ਵਿੱਤੀ ਹੱਦਾਂ ਅੰਦਰ ਕੁਝ ਅਧਿਕਾਰੀਆਂ ਨੂੰ ਦਾਅਵਿਆਂ ਦਾ ਨਿਪਟਾਰਾ ਕਰਨਾ।
- ਯੋਜਨਾਬੰਦੀ ਮੁਖੀ ਨੂੰ ਵਿਕਾਸ ਸੰਬੰਧੀ ਇਕਰਾਰਨਾਮਿਆਂ, ਕਾਨੂੰਨੀ ਰਾਹ ਅਧਿਕਾਰਾਂ ਅਤੇ ਹੋਰ ਦਸਤਾਵੇਜ਼ਾਂ ਬਾਰੇ ਗੱਲਬਾਤ ਕਰਨੀ।
- ਵਿਕਾਸ ਜ਼ਮਾਨਤਾਂ ਦੀ ਰਕਮ ਅਤੇ ਕਿਸਮ ਬਾਰੇ ਯੋਜਨਾਬੰਦੀ ਮੁਖੀ ਨੂੰ ਵਿਵੇਕ ਵਰਤਣਾ।
- ਕੁਝ ਇਕਰਾਰਨਾਮਿਆਂ ਅਤੇ ਰਾਹ ਅਧਿਕਾਰਾਂ ਨੂੰ ਰੱਦ ਕਰਨਾ ਜਾਂ ਉਨ੍ਹਾਂ ਵਿੱਚ ਛੋਟੀ ਸੋਧ ਕਰਨੀ।
- ਸੀਨੀਅਰ ਪ੍ਰਸ਼ਾਸਕੀ ਟੀਮ ਦੇ ਮੈਂਬਰਾਂ ਨੂੰ ਆਪਣੇ ਅਧੀਨ ਕਰਮਚਾਰੀਆਂ ਨੂੰ ਅਧਿਕਾਰਾਂ ਦਾ ਕੁਝ ਹਿੱਸਾ ਅੱਗੇ ਸੌਂਪਣਾ।
ਉਪਨਿਯਮ 8199 ਨੇ ਕੌਂਸਲ ਦੇ ਸਾਰੇ ਅਧਿਕਾਰ ਨਹੀਂ ਸੌਂਪੇ। ਕੌਂਸਲ ਕੋਲ ਕਾਨੂੰਨ ਬਣਾਉਣ ਵਾਲੇ ਕੰਮ ਅਤੇ ਉਹ ਅਧਿਕਾਰ ਰਹੇ ਜਿਨ੍ਹਾਂ ਨੂੰ ਕਾਨੂੰਨ ਅਨੁਸਾਰ ਅੱਗੇ ਨਹੀਂ ਸੌਂਪਿਆ ਜਾ ਸਕਦਾ।
ਫਿਰ ਵੀ, ਇਸ ਨੇ ਰੋਜ਼ਾਨਾ ਦੇ ਮਹੱਤਵਪੂਰਨ ਫ਼ੈਸਲਿਆਂ ਦੇ ਅਧਿਕਾਰ ਸੀਨੀਅਰ ਪ੍ਰਸ਼ਾਸਕੀ ਦਫ਼ਤਰਾਂ ਵਿੱਚ ਰੱਖ ਦਿੱਤੇ।
ਕੌਂਸਲ ਨੇ 9 ਜਨਵਰੀ 2023 ਨੂੰ ਇਸ ਉਪਨਿਯਮ ਨੂੰ ਸਰਬਸੰਮਤੀ ਨਾਲ ਅਪਣਾਇਆ। ਅੰਤਿਮ ਮਨਜ਼ੂਰੀ ਦਾ ਮਤਾ ਕੌਂਸਲਰ ਡੈਨੀਅਲ ਬੋਇਵਰਟ ਨੇ ਪੇਸ਼ ਕੀਤਾ ਅਤੇ ਕੌਂਸਲਰ ਐਲੀਸ਼ੀਆ ਗੁਈਚਨ ਨੇ ਇਸ ਦੀ ਤਾਈਦ ਕੀਤੀ। 9 ਜਨਵਰੀ 2023 ਦੀ ਅਧਿਕਾਰਤ ਕਾਰਵਾਈ ਵਿੱਚ ਵੋਟ ਦਰਜ ਹੈ।
ਸਾਰੇ ਸੌਂਪੇ ਗਏ ਅਧਿਕਾਰ ਅਤੇ ਹੱਦਾਂ ਅਧਿਕਾਰਤ ਉਪਨਿਯਮ 8199 ਵਿੱਚ ਦਿੱਤੀਆਂ ਗਈਆਂ ਹਨ।
ਉਪਨਿਯਮ 8347 ਨੇ ਹੋਰ ਕੀ ਜੋੜਿਆ?
ਵਿਕਾਸ ਅਰਜ਼ੀ ਕਾਰਵਾਈ ਉਪਨਿਯਮ ਨੰਬਰ 8347 ਨੇ ਵਿਕਾਸ ਪ੍ਰਬੰਧ ਵਿੱਚ ਅਧਿਕਾਰਾਂ ਦਾ ਹੋਰ ਵਿਸਥਾਰ ਕੀਤਾ।
ਇਸ ਨੇ ਕੌਂਸਲ ਦੀਆਂ ਨਿਰਧਾਰਤ “ਸ਼ਕਤੀਆਂ, ਫ਼ਰਜ਼ ਅਤੇ ਕਾਰਜ” ਵਿਕਾਸ ਅਰਜ਼ੀਆਂ ਲਈ ਜ਼ਿੰਮੇਵਾਰ ਮਹਾਂਪ੍ਰਬੰਧਕ ਨੂੰ ਸੌਂਪੇ।
ਇਨ੍ਹਾਂ ਵਿੱਚ ਹੇਠ ਲਿਖੇ ਅਧਿਕਾਰ ਸ਼ਾਮਲ ਸਨ:
- ਸਰਕਾਰੀ ਭਾਈਚਾਰਕ ਯੋਜਨਾ ਅਨੁਸਾਰ ਮੁੜ-ਜ਼ੋਨਿੰਗ ਲਈ ਜਨਤਕ ਸੁਣਵਾਈ ਕਰਨੀ ਹੈ ਜਾਂ ਨਹੀਂ, ਇਹ ਫ਼ੈਸਲਾ ਕਰਨਾ।
- ਜਿੱਥੇ ਕੋਈ ਛੋਟ ਨਹੀਂ ਜਾਂ ਕੇਵਲ ਛੋਟੀ ਛੋਟ ਮੰਗੀ ਗਈ ਹੋਵੇ, ਉੱਥੇ ਵਿਕਾਸ ਪਰਮਿਟ ਜਾਰੀ ਜਾਂ ਸੋਧਣਾ।
- ਆਰਜ਼ੀ ਵਰਤੋਂ ਪਰਮਿਟ ਜਾਰੀ, ਸੋਧ ਜਾਂ ਨਵਿਆਉਣਾ।
- ਮੁੜ-ਜ਼ੋਨਿੰਗ ਅਰਜ਼ੀ ਦੀ ਤੀਜੀ ਪੜ੍ਹਤ ਤੋਂ ਬਾਅਦ ਕੁਝ ਮਿਆਦ ਵਾਧੇ ਮਨਜ਼ੂਰ ਕਰਨਾ।
- ਛੋਟੇ ਵਿਕਾਸ ਫ਼ਰਕ ਪਰਮਿਟ ਜਾਰੀ ਕਰਨਾ।
- ਪਿੱਛੇ ਹਟਾਵਾਂ, ਇਮਾਰਤੀ ਉਚਾਈ, ਜ਼ਮੀਨੀ ਢੱਕਵਾਂ, ਵਾਹਨ ਖੜ੍ਹੇ ਕਰਨ, ਮਾਲ ਚੜ੍ਹਾਉਣ, ਪਰਦੇਦਾਰੀ ਅਤੇ ਭੂ-ਸਜਾਵਟ ਨਾਲ ਸੰਬੰਧਿਤ ਛੋਟਾਂ ਉੱਤੇ ਵਿਚਾਰ ਕਰਨਾ।
- ਵਿਕਾਸ ਜ਼ਮਾਨਤਾਂ ਮੰਗਣੀਆਂ।
- ਅਰਜ਼ੀ ਪੱਤਰ ਅਤੇ ਸਹਾਇਕ ਜਾਣਕਾਰੀ ਨਿਰਧਾਰਤ ਕਰਨੀ।
- ਤਕਨੀਕੀ ਅਧਿਐਨ ਅਤੇ ਵਿਕਾਸ ਮਨਜ਼ੂਰੀ ਜਾਣਕਾਰੀ ਮੰਗਣੀ।
- ਵਿਕਾਸ ਦੀਆਂ ਸ਼ਰਤਾਂ ਵਜੋਂ ਇਕਰਾਰਨਾਮੇ, ਕਾਨੂੰਨੀ ਰਾਹ ਅਧਿਕਾਰ ਅਤੇ ਸਹੂਲਤ ਅਧਿਕਾਰ ਕਰਨਾ ਜਾਂ ਸੋਧਣਾ।
- ਪਰਮਿਟ ਅਤੇ ਹੋਰ ਵਿਕਾਸ ਦਸਤਾਵੇਜ਼ਾਂ ਉੱਤੇ ਕਾਰਵਾਈ ਕਰਨੀ।
- ਜਟਿਲਤਾ, ਜਨਤਕ ਹਿੱਤ ਜਾਂ ਕਿਸੇ ਹੋਰ ਹਾਲਾਤ ਕਰਕੇ ਕੋਈ ਮਾਮਲਾ ਵਾਪਸ ਕੌਂਸਲ ਕੋਲ ਭੇਜਣਾ ਹੈ ਜਾਂ ਨਹੀਂ, ਇਹ ਫ਼ੈਸਲਾ ਕਰਨਾ।
6 ਨਵੰਬਰ 2023 ਦੀ ਨਗਰ ਰਿਪੋਰਟ ਅਨੁਸਾਰ ਮਕਸਦ ਅਰਜ਼ੀ ਪ੍ਰਕਿਰਿਆ ਨੂੰ ਆਧੁਨਿਕ ਬਣਾਉਣਾ, ਵਿਕਾਸ ਤੇਜ਼ ਕਰਨਾ ਅਤੇ ਸੂਬਾਈ ਰਿਹਾਇਸ਼ੀ ਉਪਰਾਲਿਆਂ ਦੀ ਸਹਾਇਤਾ ਕਰਨੀ ਸੀ।
ਉਸੇ ਰਿਪੋਰਟ ਵਿੱਚ ਦਰਜ ਹੈ ਕਿ ਨਗਰ ਕਰਮਚਾਰੀਆਂ ਨੇ ਸ਼ਹਿਰੀ ਵਿਕਾਸ ਸੰਸਥਾ ਨਾਲ ਸਲਾਹ ਕੀਤੀ ਅਤੇ ਉਸ ਸੰਸਥਾ ਨੇ ਪ੍ਰਸਤਾਵਿਤ ਤੇਜ਼ ਕਾਰਵਾਈ ਦਾ ਸਮਰਥਨ ਕੀਤਾ।
ਰਿਪੋਰਟ ਵਿੱਚ ਵਧੇ ਅਧਿਕਾਰ ਮਨਜ਼ੂਰ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਵਸਨੀਕਾਂ, ਮੁਹੱਲਾ ਸੰਸਥਾਵਾਂ ਜਾਂ ਕਿਸੇ ਸੁਤੰਤਰ ਜਨਹਿੱਤ ਸੰਸਥਾ ਨਾਲ ਇਸੇ ਤਰ੍ਹਾਂ ਦੀ ਸਲਾਹ ਦਾ ਜ਼ਿਕਰ ਨਹੀਂ ਮਿਲਦਾ।
ਪ੍ਰਸ਼ਾਸਨ ਨੂੰ ਹੋਰ ਵਿਕਾਸ ਅਧਿਕਾਰ ਸੌਂਪਣ ਤੋਂ ਪਹਿਲਾਂ ਵਿਕਾਸ ਉਦਯੋਗ ਦੀ ਸੰਸਥਾ ਨਾਲ ਸਲਾਹ ਕਿਉਂ ਕੀਤੀ ਗਈ, ਜਦੋਂ ਵਸਨੀਕਾਂ ਨਾਲ ਬਰਾਬਰ ਦੀ ਸਲਾਹ ਦਾ ਕੋਈ ਜ਼ਿਕਰ ਨਹੀਂ ਮਿਲਦਾ?
ਅਧਿਕਾਰਤ ਰਿਪੋਰਟ ਅਤੇ ਪ੍ਰਸਤਾਵਿਤ ਉਪਨਿਯਮ 8347 ਵਿੱਚ ਵਧੇ ਹੋਏ ਕਰਮਚਾਰੀ ਅਧਿਕਾਰ ਦਰਜ ਹਨ।
ਵਿਕਾਸ ਅਧਿਕਾਰ ਸਭ ਤੋਂ ਪਹਿਲਾਂ ਕਿਸ ਨੇ ਵਰਤੇ?
ਜਦੋਂ 4 ਦਸੰਬਰ 2023 ਨੂੰ ਉਪਨਿਯਮ 8347 ਅਪਣਾਇਆ ਗਿਆ, ਡੋਰੀਐਨ ਮੇਹਿਊ ਡੈਲਟਾ ਦੀ ਵਿਕਾਸ ਮਹਾਂਪ੍ਰਬੰਧਕ ਸੀ।
ਸ਼੍ਰੀਮਤੀ ਮੇਹਿਊ ਨੇ ਨਵਾਂ ਉਪਨਿਯਮ ਅਪਣਾਉਣ ਦੀ ਸਿਫ਼ਾਰਸ਼ ਵਾਲੀ ਕਰਮਚਾਰੀ ਰਿਪੋਰਟ ਉੱਤੇ ਦਸਤਖ਼ਤ ਕੀਤੇ। ਵਿਕਾਸ ਮਹਾਂਪ੍ਰਬੰਧਕ ਵਜੋਂ ਉਨ੍ਹਾਂ ਦਾ ਦਫ਼ਤਰ ਵਿਕਾਸ ਵਿਭਾਗ ਚਲਾਉਂਦਾ, ਕੌਂਸਲ ਨੂੰ ਸਲਾਹ ਦਿੰਦਾ ਅਤੇ ਮਹਾਂਪ੍ਰਬੰਧਕ ਨੂੰ ਸੌਂਪੇ ਅਧਿਕਾਰ ਵਰਤਦਾ ਸੀ।
ਇਸ ਗੱਲ ਨੂੰ ਗਲਤ ਢੰਗ ਨਾਲ ਪੇਸ਼ ਨਹੀਂ ਕਰਨਾ ਚਾਹੀਦਾ। ਸ਼੍ਰੀਮਤੀ ਮੇਹਿਊ ਚੁਣੀ ਹੋਈ ਕੌਂਸਲਰ ਨਹੀਂ ਬਣੀ ਅਤੇ ਉਨ੍ਹਾਂ ਨੂੰ ਕੌਂਸਲ ਦੀਆਂ ਸਾਰੀਆਂ ਜ਼ਿੰਮੇਵਾਰੀਆਂ ਨਹੀਂ ਮਿਲੀਆਂ।
ਪਰ ਉਨ੍ਹਾਂ ਦਾ ਦਫ਼ਤਰ ਦੋ ਆਪਸ ਵਿੱਚ ਜੁੜੇ ਕੰਮ ਕਰ ਰਿਹਾ ਸੀ:
- ਵਿਕਾਸ ਵਿਭਾਗ ਦੀ ਪ੍ਰਸ਼ਾਸਕੀ ਮੁਖੀ ਵਜੋਂ ਕੌਂਸਲ ਨੂੰ ਸਲਾਹ ਦੇਣਾ।
- ਉਪਨਿਯਮ 8347 ਰਾਹੀਂ ਸੌਂਪੇ ਗਏ ਕੌਂਸਲ ਦੇ ਨਿਰਧਾਰਤ ਅਧਿਕਾਰ ਵਰਤਣਾ।
2026 ਤੱਕ ਸ਼੍ਰੀਮਤੀ ਮੇਹਿਊ ਸਹੂਲਤਾਂ ਅਤੇ ਵੱਡੇ ਪ੍ਰੋਜੈਕਟਾਂ ਦੀ ਮਹਾਂਪ੍ਰਬੰਧਕ ਬਣ ਗਈ ਸੀ। ਕਿਉਂਕਿ ਅਧਿਕਾਰ ਉਨ੍ਹਾਂ ਨੂੰ ਨਿੱਜੀ ਤੌਰ ਉੱਤੇ ਨਹੀਂ ਸਗੋਂ ਵਿਕਾਸ ਵਾਲੇ ਅਹੁਦੇ ਨੂੰ ਦਿੱਤੇ ਗਏ ਸਨ, ਇਸ ਲਈ ਇਹ ਅਧਿਕਾਰ ਉਸ ਅਹੁਦੇ ਜਾਂ ਵਿਕਾਸ ਅਰਜ਼ੀਆਂ ਲਈ ਜ਼ਿੰਮੇਵਾਰ ਉਤਰਾਧਿਕਾਰੀ ਕੋਲ ਜਾਂਦੇ ਹਨ।
ਇਸ ਲਈ ਮਸਲਾ ਕਿਸੇ ਵਿਅਕਤੀ ਦਾ ਨਹੀਂ, ਸਗੋਂ ਸੰਸਥਾਗਤ ਬਣਤਰ ਦਾ ਹੈ।

ਲਿਖਤੀ ਸੂਚਨਾ ਮਿਲਣ ਤੋਂ 14 ਦਿਨਾਂ ਅੰਦਰ ਅਰਜ਼ੀਦਾਰ ਕੌਂਸਲ ਕੋਲ ਸੌਂਪੇ ਗਏ ਫ਼ੈਸਲੇ ਦੀ ਮੁੜ ਵਿਚਾਰ ਬੇਨਤੀ ਕਰ ਸਕਦਾ ਹੈ। ਬੇਨਤੀ ਨਗਰ ਲਿਪਿਕ ਨੂੰ ਦਿੱਤੀ ਜਾਂਦੀ ਹੈ, ਫ਼ੈਸਲਾ ਕਰਨ ਵਾਲੇ ਅਧਿਕਾਰੀ ਨੂੰ ਲਿਖਤੀ ਵਿਆਖਿਆ ਤਿਆਰ ਕਰਨੀ ਪੈਂਦੀ ਹੈ ਅਤੇ ਮਾਮਲਾ ਜਿੰਨੀ ਜਲਦੀ ਵਾਜਬ ਹੋਵੇ ਕੌਂਸਲ ਅੱਗੇ ਰੱਖਣਾ ਲਾਜ਼ਮੀ ਹੈ।
ਪਰ ਇਹ ਸੁਰੱਖਿਆ ਸੀਮਤ ਹੈ:
- ਇਹ ਵਿਕਾਸ ਅਰਜ਼ੀਦਾਰ ਦੀ ਰੱਖਿਆ ਕਰਦੀ ਦਿਸਦੀ ਹੈ, ਲਾਜ਼ਮੀ ਤੌਰ ਉੱਤੇ ਗੁਆਂਢੀਆਂ ਜਾਂ ਹੋਰ ਪ੍ਰਭਾਵਿਤ ਵਸਨੀਕਾਂ ਦੀ ਨਹੀਂ।

- ਇਹ ਲਿਖਤੀ ਸੂਚਨਾ ਮਿਲਣ ਤੋਂ ਬਾਅਦ ਹੀ ਚੱਲਦੀ ਹੈ।
- ਇਹ ਸੌਂਪੇ ਫ਼ੈਸਲਿਆਂ ਦਾ ਪੂਰਾ ਜਨਤਕ ਰਜਿਸਟਰ ਨਹੀਂ ਬਣਾਉਂਦੀ।
- ਇਹ ਹਰ ਫ਼ੈਸਲਾ ਅਤੇ ਉਸ ਦੇ ਕਾਰਨ ਪ੍ਰਕਾਸ਼ਿਤ ਕਰਨ ਦੀ ਮੰਗ ਨਹੀਂ ਕਰਦੀ।
- ਇਹ ਵਸਨੀਕਾਂ ਨੂੰ ਨਿਯਮਤ ਅੰਕੜੇ ਨਹੀਂ ਦਿੰਦੀ ਕਿ ਅਧਿਕਾਰ ਕਿਵੇਂ ਵਰਤੇ ਜਾ ਰਹੇ ਹਨ।
ਸੀਮਤ ਮੁੜ ਵਿਚਾਰ ਪ੍ਰਕਿਰਿਆ ਲਗਾਤਾਰ ਜਨਤਕ ਨਿਗਰਾਨੀ ਦੇ ਬਰਾਬਰ ਨਹੀਂ ਹੈ।
ਲਾਜ਼ਮੀ ਜਨਤਕ ਰਿਪੋਰਟਿੰਗ ਕਿੱਥੇ ਹੈ?
ਉਪਨਿਯਮ 8199 ਜਾਂ 8347 ਵਿੱਚੋਂ ਕੋਈ ਵੀ ਸੌਂਪੇ ਅਧਿਕਾਰ ਦੀ ਹਰ ਵਰਤੋਂ ਦਰਸਾਉਂਦੀ ਪੂਰੀ ਸਾਲਾਨਾ ਜਨਤਕ ਰਿਪੋਰਟ ਲਾਜ਼ਮੀ ਕਰਦਾ ਨਹੀਂ ਦਿਸਦਾ।
ਉਪਨਿਯਮ ਹੇਠ ਲਿਖੀਆਂ ਗੱਲਾਂ ਦੇ ਪ੍ਰਕਾਸ਼ਨ ਨੂੰ ਲਾਜ਼ਮੀ ਕਰਦੇ ਨਹੀਂ ਦਿਸਦੇ:
- ਹਰ ਸੌਂਪੀ ਮਨਜ਼ੂਰੀ ਜਾਂ ਇਨਕਾਰ।
- ਪ੍ਰਸ਼ਾਸਕੀ ਤੌਰ ਉੱਤੇ ਮਨਜ਼ੂਰ ਹਰ ਵਿਕਾਸ ਪਰਮਿਟ।
- ਹਰ ਮਨਜ਼ੂਰ ਜਾਂ ਰੱਦ ਕੀਤੀ ਛੋਟੀ ਛੋਟ।
- ਹਰ ਮਨਜ਼ੂਰ ਮਿਆਦ ਵਾਧਾ।
- ਹਰ ਇਕਰਾਰਨਾਮਾ ਜਾਂ ਕਾਨੂੰਨੀ ਰਾਹ ਅਧਿਕਾਰ ਜਿਸ ਉੱਤੇ ਗੱਲਬਾਤ, ਸੋਧ ਜਾਂ ਰੱਦਗੀ ਹੋਈ।
- ਹਰ ਨਿਰਧਾਰਤ ਜਾਂ ਬਦਲੀ ਗਈ ਜ਼ਮਾਨਤ ਰਕਮ।
- ਜਨਤਕ ਸੁਣਵਾਈ ਨਾ ਕਰਨ ਦਾ ਹਰ ਫ਼ੈਸਲਾ।
- ਕਿਸੇ ਹੋਰ ਕਰਮਚਾਰੀ ਨੂੰ ਅੱਗੇ ਸੌਂਪਿਆ ਹਰ ਅਧਿਕਾਰ।
- ਹਰ ਫ਼ੈਸਲੇ ਦੇ ਲਿਖਤੀ ਕਾਰਨ।
- ਹਰ ਅਧਿਕਾਰ ਕਿੰਨੀ ਵਾਰ ਵਰਤਿਆ ਗਿਆ, ਇਸ ਦੇ ਅੰਕੜੇ।
- ਫ਼ੈਸਲਿਆਂ ਦੀ ਇਕਸਾਰਤਾ ਦੀ ਨਿਯਮਤ ਸੁਤੰਤਰ ਜਾਂਚ।
ਲਾਜ਼ਮੀ ਰਿਪੋਰਟਿੰਗ ਦੀ ਗੈਰਹਾਜ਼ਰੀ ਕਿਸੇ ਕਰਮਚਾਰੀ ਦੀ ਗਲਤ ਕਾਰਵਾਈ ਸਾਬਤ ਨਹੀਂ ਕਰਦੀ।
ਇਸ ਦਾ ਮਤਲਬ ਹੈ ਕਿ ਵਸਨੀਕਾਂ ਕੋਲ ਇਹ ਜਾਣਨ ਲਈ ਲੋੜੀਂਦੀ ਜਾਣਕਾਰੀ ਨਹੀਂ ਹੋ ਸਕਦੀ ਕਿ ਅਧਿਕਾਰ ਇਕਸਾਰ, ਨਿਆਂਸੰਗਤ ਅਤੇ ਕੌਂਸਲ ਦੀ ਮਨਸ਼ਾ ਅਨੁਸਾਰ ਵਰਤੇ ਗਏ ਜਾਂ ਨਹੀਂ।
ਇਹੀ ਜਵਾਬਦੇਹੀ ਦੀ ਖਾਈ ਹੈ।
ਜਨਤਕ ਸੂਚਨਾ ਵੀ ਘਟਾਈ ਗਈ
ਬਾਅਦ ਵਿੱਚ ਕੌਂਸਲ ਨੇ ਉਪਨਿਯਮ 8347 ਵਿੱਚ ਸੋਧ ਕੀਤੀ।
21 ਅਕਤੂਬਰ 2024 ਨੂੰ ਕੌਂਸਲ ਨੇ ਸੋਧ ਉਪਨਿਯਮ 8443 ਸਰਬਸੰਮਤੀ ਨਾਲ ਅਪਣਾਇਆ। ਇਸ ਨੇ ਮਹਾਂਪ੍ਰਬੰਧਕ ਵੱਲੋਂ ਸੌਂਪੀ ਛੋਟੀ ਵਿਕਾਸ ਛੋਟ ਦੀ ਅਰਜ਼ੀ ਉੱਤੇ ਵਿਚਾਰ ਕਰਨ ਤੋਂ ਪਹਿਲਾਂ ਆਲੇ-ਦੁਆਲੇ ਦੇ ਮਾਲਕਾਂ ਅਤੇ ਕਿਰਾਏਦਾਰਾਂ ਨੂੰ ਡਾਕ ਰਾਹੀਂ ਸੂਚਨਾ ਦੇਣ ਦੀ ਸ਼ਰਤ ਹਟਾ ਦਿੱਤੀ।
ਸ਼ਹਿਰ ਨੇ ਕਿਹਾ ਕਿ ਇਹ ਸੋਧ ਡੈਲਟਾ ਦੀ ਕਾਰਵਾਈ ਨੂੰ ਸਥਾਨਕ ਸਰਕਾਰ ਕਾਨੂੰਨ ਨਾਲ ਮੇਲ ਖਵਾਏਗੀ ਅਤੇ ਸਮਾਂ ਘਟਾਏਗੀ।
18 ਨਵੰਬਰ 2024 ਨੂੰ ਕੌਂਸਲ ਨੇ ਸੋਧ ਉਪਨਿਯਮ 8451 ਅਪਣਾਇਆ। ਇਸ ਨੇ ਵਿਕਾਸ ਮਹਾਂਪ੍ਰਬੰਧਕ ਨੂੰ ਸਰਕਾਰੀ ਭਾਈਚਾਰਕ ਯੋਜਨਾ ਅਨੁਸਾਰ ਕੁਝ ਛੋਟੇ ਪੱਧਰ ਦੇ ਬਹੁ-ਇਕਾਈ ਰਿਹਾਇਸ਼ੀ ਮੁੜ-ਜ਼ੋਨਿੰਗ ਮਾਮਲਿਆਂ ਲਈ ਅਰਜ਼ੀ ਸੂਚਨਾ-ਪਟ ਦੀਆਂ ਸ਼ਰਤਾਂ ਬਦਲਣ ਜਾਂ ਪੂਰੀ ਤਰ੍ਹਾਂ ਮੁਆਫ਼ ਕਰਨ ਦੀ ਆਗਿਆ ਦਿੱਤੀ।
ਦੱਸਿਆ ਗਿਆ ਮਕਸਦ ਫਿਰ ਕਾਰਵਾਈ ਤੇਜ਼ ਕਰਨਾ ਸੀ।
ਪਰ ਜਦੋਂ ਪ੍ਰਸ਼ਾਸਕੀ ਅਧਿਕਾਰ ਵਧਣ ਅਤੇ ਸੂਚਨਾ, ਦਿੱਖ ਅਤੇ ਰਿਪੋਰਟਿੰਗ ਘਟਣ, ਤਾਂ ਤੇਜ਼ ਕਾਰਵਾਈ ਦੀ ਜਨਤਕ ਕੀਮਤ ਹੋ ਸਕਦੀ ਹੈ।
ਸੂਬਾਈ ਰਿਹਾਇਸ਼ੀ ਕਾਨੂੰਨ ਨੇ ਕੌਂਸਲ ਦੀ ਜ਼ਿੰਮੇਵਾਰੀ ਖ਼ਤਮ ਨਹੀਂ ਕੀਤੀ
ਸੂਬਾਈ ਰਿਹਾਇਸ਼ੀ ਉਪਰਾਲਿਆਂ ਨੇ ਨਗਰਪਾਲਿਕਾਵਾਂ ਉੱਤੇ ਰਿਹਾਇਸ਼ੀ ਮਨਜ਼ੂਰੀਆਂ ਤੇਜ਼ ਕਰਨ ਦਾ ਦਬਾਅ ਪਾਇਆ।
ਕਾਨੂੰਨੀ ਮਸੌਦਾ 44 ਨੇ ਸਥਾਨਕ ਸਰਕਾਰਾਂ ਨੂੰ ਨਿਰਧਾਰਤ ਛੋਟੇ ਪੱਧਰ ਦੇ ਬਹੁ-ਇਕਾਈ ਘਰਾਂ ਦੀ ਆਗਿਆ ਦੇਣ ਲਈ ਕਿਹਾ। ਬਾਅਦ ਵਿੱਚ ਕਾਨੂੰਨੀ ਮਸੌਦਾ 25 ਨੇ ਉਨ੍ਹਾਂ ਨਗਰ ਨਿਯਮਾਂ ਅਤੇ ਰੁਕਾਵਟਾਂ ਨੂੰ ਸੰਬੋਧਿਆ ਜੋ ਇਨ੍ਹਾਂ ਆਗਿਆਵਾਂ ਨੂੰ ਅਸਰਹੀਣ ਕਰ ਸਕਦੀਆਂ ਸਨ।
ਪਰ ਸੂਬਾਈ ਰਿਹਾਇਸ਼ੀ ਕਾਨੂੰਨ ਨੇ ਡੈਲਟਾ ਕੌਂਸਲ ਨੂੰ ਆਪਣੀ ਨਿਗਰਾਨੀ ਦੀ ਜ਼ਿੰਮੇਵਾਰੀ ਛੱਡਣ ਲਈ ਨਹੀਂ ਕਿਹਾ।
ਕੌਂਸਲ ਕਰਮਚਾਰੀਆਂ ਤੋਂ ਉਪਨਿਯਮ ਤਿਆਰ ਕਰਵਾ ਸਕਦੀ, ਅਰਜ਼ੀਆਂ ਦੀ ਕਾਰਵਾਈ ਕਰਵਾ ਸਕਦੀ ਅਤੇ ਮਾਹਰ ਸਲਾਹ ਲੈ ਸਕਦੀ ਸੀ। ਫਿਰ ਵੀ ਚੁਣੇ ਨੁਮਾਇੰਦੇ ਇਹ ਨਿਰਧਾਰਤ ਕਰਨ ਲਈ ਜ਼ਿੰਮੇਵਾਰ ਰਹੇ ਕਿ ਡੈਲਟਾ ਦੇ ਉਪਨਿਯਮ ਸੂਬਾਈ ਸ਼ਰਤਾਂ ਦੀ ਕਾਗਜ਼ੀ ਅਤੇ ਅਮਲੀ ਪਾਲਣਾ ਕਰਦੇ ਹਨ ਜਾਂ ਨਹੀਂ।
ਇਸ ਵਿੱਚ ਇਹ ਜਾਂਚਣਾ ਵੀ ਸ਼ਾਮਲ ਹੈ ਕਿ ਮੌਜੂਦਾ ਵਿਸ਼ੇਸ਼ ਵਿਕਾਸ ਖੇਤਰ, ਜ਼ਮੀਨੀ ਢੱਕਵਾਂ ਹੱਦਾਂ, ਪਿੱਛੇ ਹਟਾਵਾਂ, ਉਚਾਈ ਪਾਬੰਦੀਆਂ, ਵਾਹਨ ਖੜ੍ਹੇ ਕਰਨ ਦੇ ਨਿਯਮ, ਪਹੁੰਚ ਸ਼ਰਤਾਂ ਅਤੇ ਹੋਰ ਨਗਰ ਸ਼ਰਤਾਂ ਸੂਬਾਈ ਕਾਨੂੰਨ ਵਿੱਚ ਸੋਚੀ ਗਈ ਰਿਹਾਇਸ਼ੀ ਸਮਰੱਥਾ ਨੂੰ ਰੋਕਦੀਆਂ ਤਾਂ ਨਹੀਂ।
ਕੌਂਸਲ ਕੇਵਲ ਇਹ ਕਹਿ ਕੇ ਇਨ੍ਹਾਂ ਚਿੰਤਾਵਾਂ ਦਾ ਜਵਾਬ ਨਹੀਂ ਦੇ ਸਕਦੀ ਕਿ ਕਰਮਚਾਰੀਆਂ ਨੇ ਡੈਲਟਾ ਨੂੰ ਪਾਲਣਾ ਕਰਦਾ ਦੱਸਿਆ ਸੀ।
ਚੁਣੇ ਨੁਮਾਇੰਦਿਆਂ ਤੋਂ ਮਸਲਾ ਪੜ੍ਹਨ, ਵਿਸ਼ਲੇਸ਼ਣ ਉੱਤੇ ਸਵਾਲ ਕਰਨ ਅਤੇ ਆਪਣੇ ਨਤੀਜੇ ਜਨਤਕ ਤੌਰ ਉੱਤੇ ਸਮਝਾਉਣ ਦੀ ਉਮੀਦ ਕੀਤੀ ਜਾਂਦੀ ਹੈ।
ਅਗਲੀ ਚਿੰਤਾ: ਕੌਂਸਲ ਤੱਕ ਪਹੁੰਚ ਕੌਣ ਨਿਯੰਤਰਿਤ ਕਰਦਾ ਹੈ?
ਸ਼ਾਸਨ ਸੰਬੰਧੀ ਚਿੰਤਾ ਵਿਕਾਸ ਫ਼ੈਸਲਿਆਂ ਨਾਲ ਖ਼ਤਮ ਨਹੀਂ ਹੁੰਦੀ।
ਕੌਂਸਲ ਕਾਰਵਾਈ ਉਪਨਿਯਮ ਨੰਬਰ 8330 ਉਨ੍ਹਾਂ ਵਸਨੀਕਾਂ ਅਤੇ ਸੰਸਥਾਵਾਂ ਦੀਆਂ ਬੇਨਤੀਆਂ ਨੂੰ ਨਿਯਮਤ ਕਰਦਾ ਹੈ ਜੋ ਵਫ਼ਦ ਵਜੋਂ ਕੌਂਸਲ ਅੱਗੇ ਪੇਸ਼ ਹੋਣਾ ਚਾਹੁੰਦੇ ਹਨ।
ਉਪਨਿਯਮ 8330 ਬਾਰੇ ਡੀਸੀਸੀ ਨਾਊ ਨੂੰ ਦਿੱਤੇ ਲਿਖਤੀ ਜਵਾਬ ਵਿੱਚ ਵਨ ਡੈਲਟਾ ਨੇ ਵਫ਼ਦ ਬੇਨਤੀਆਂ ਦੀ ਮਨਜ਼ੂਰੀ ਨਿਗਮ ਅਧਿਕਾਰੀ ਵੱਲੋਂ ਕਰਨ ਦਾ ਸਮਰਥਨ ਕੀਤਾ।
ਡੈਲਟਾ ਦੇ ਵਸਨੀਕ ਨਿਗਮ ਅਧਿਕਾਰੀ ਨੂੰ ਨਹੀਂ ਚੁਣਦੇ। ਇਹ ਨਿਯੁਕਤ ਅਹੁਦਾ ਹੈ।
ਪ੍ਰਸ਼ਾਸਕੀ ਕਰਮਚਾਰੀ ਵਾਜਬ ਤੌਰ ਉੱਤੇ ਜਾਂਚ ਸਕਦੇ ਹਨ ਕਿ ਬੇਨਤੀ ਪੂਰੀ ਹੈ ਜਾਂ ਨਹੀਂ, ਪੇਸ਼ੀ ਦਾ ਸਮਾਂ ਤੈਅ ਕਰ ਸਕਦੇ ਹਨ ਅਤੇ ਨਿਰਪੱਖ ਕਾਰਵਾਈ ਨਿਯਮ ਲਾਗੂ ਕਰ ਸਕਦੇ ਹਨ। ਪਰ ਕਿਸ ਵਸਨੀਕ ਨੂੰ ਚੁਣੀ ਕੌਂਸਲ ਅੱਗੇ ਬੋਲਣ ਦੀ ਆਗਿਆ ਮਿਲੇ, ਇਸ ਦਾ ਅੰਤਿਮ ਅਧਿਕਾਰ ਕਿਸੇ ਗੈਰ-ਚੁਣੇ ਅਧਿਕਾਰੀ ਨੂੰ ਦੇਣਾ ਇੱਕ ਵੱਡਾ ਲੋਕਤੰਤਰੀ ਸਵਾਲ ਖੜ੍ਹਾ ਕਰਦਾ ਹੈ।

- ਕੀ ਵਸਨੀਕ ਸਿੱਧੀ ਕੌਂਸਲ ਕੋਲ ਅਪੀਲ ਕਰ ਸਕਦਾ ਹੈ?
- ਕੀ ਕੌਂਸਲਰਾਂ ਨੂੰ ਦੱਸਿਆ ਜਾਂਦਾ ਹੈ ਕਿ ਬੇਨਤੀ ਮਿਲੀ ਅਤੇ ਰੱਦ ਹੋਈ?

ਕੀ ਨਿਗਮ ਅਧਿਕਾਰੀ ਨਿਰਪੱਖ ਨਿਯਮਾਂ ਅਧੀਨ ਕੇਵਲ ਵਫ਼ਦ ਬੇਨਤੀਆਂ ਦੀ ਕਾਰਵਾਈ ਕਰੇਗਾ, ਜਾਂ ਉਸ ਕੋਲ ਵਸਨੀਕਾਂ ਨੂੰ ਕੌਂਸਲ ਅੱਗੇ ਪੇਸ਼ ਹੋਣ ਤੋਂ ਰੋਕਣ ਦਾ ਅੰਤਿਮ ਵਿਵੇਕ ਹੋਵੇਗਾ?
ਲਿਖਤੀ ਕਾਰਨਾਂ, ਜਨਤਕ ਰਿਕਾਰਡਾਂ ਅਤੇ ਕੌਂਸਲ ਕੋਲ ਅਪੀਲ ਤੋਂ ਬਿਨਾਂ ਪ੍ਰਸ਼ਾਸਕੀ ਜਾਂਚ ਪ੍ਰਸ਼ਾਸਕੀ ਦਰਬਾਨੀ ਬਣ ਜਾਂਦੀ ਹੈ।
ਕੌਂਸਲ “ਕਰਮਚਾਰੀਆਂ ਦੇ ਫ਼ੈਸਲੇ” ਕਹਿ ਕੇ ਜ਼ਿੰਮੇਵਾਰੀ ਤੋਂ ਨਹੀਂ ਬਚ ਸਕਦੀ
ਕੌਂਸਲ ਨੇ:
- ਉਪਨਿਯਮ 8199, 8330 ਅਤੇ 8347 ਅਪਣਾਏ।
- ਅਧਿਕਾਰ ਪ੍ਰਾਪਤ ਕਰਨ ਵਾਲੇ ਅਹੁਦੇ ਚੁਣੇ।
- ਅਧਿਕਾਰਾਂ ਦੀ ਹੱਦ ਤੈਅ ਕੀਤੀ।
- ਪੂਰੀ ਰਿਪੋਰਟਿੰਗ ਦੀ ਲਾਜ਼ਮੀ ਸ਼ਰਤ ਨਾ ਰੱਖਣ ਨੂੰ ਮਨਜ਼ੂਰ ਕੀਤਾ।
- ਨਿਯਮਤ ਰਿਪੋਰਟਾਂ ਮੰਗ ਸਕਦੀ ਹੈ।
- ਪ੍ਰਬੰਧ ਦੀ ਕਾਰਗੁਜ਼ਾਰੀ ਦੀ ਸਮੀਖਿਆ ਕਰ ਸਕਦੀ ਹੈ।
- ਉਪਨਿਯਮ ਸੋਧ ਜਾਂ ਰੱਦ ਕਰ ਸਕਦੀ ਹੈ।
- ਵੋਟਰਾਂ ਅੱਗੇ ਜਵਾਬਦੇਹ ਰਹਿੰਦੀ ਹੈ।
ਇਸ ਲਈ ਕੌਂਸਲ ਕਿਸੇ ਵਿਵਾਦਿਤ ਫ਼ੈਸਲੇ ਨੂੰ ਕੇਵਲ ਕਰਮਚਾਰੀ ਮਾਮਲਾ ਕਹਿ ਕੇ ਆਪਣੇ ਆਪ ਨੂੰ ਪੂਰੀ ਤਰ੍ਹਾਂ ਵੱਖ ਨਹੀਂ ਕਰ ਸਕਦੀ।
