Delegation of Authority Bylaw No. 8199 — What It Does and What It Does Not Do
Bylaw No. 8199 is the City of Delta’s Delegation of Authority Bylaw. It was adopted under section 154 of the Community Charter, which allows a municipal council to delegate certain powers, duties and functions to officers and employees.
What the bylaw does
Bylaw 8199 delegates operational and administrative authorities to City staff so that day-to-day work can proceed without every item returning to Council. The main areas include:
- Procurement — authority to negotiate, approve, award and execute contracts for goods and services, subject to the levels set out in the Purchasing Policy.
- Disposal of surplus assets — authority to declare and dispose of surplus assets (excluding real property).
- Day-to-day operations — authority for members of the Staff Leadership Team to negotiate and execute agreements within their areas of responsibility, subject to value limits.
- Implementation of Council decisions — authority to carry out transactions and agreements that Council has already approved.
The bylaw also allows members of the Staff Leadership Team to sub-delegate portions of their authority to employees they directly supervise, while remaining accountable for the exercise of that authority.
Important limits
- Council must still approve the acquisition or disposition of land or improvements to land (section 4.2).
- All delegations remain subject to the Community Charter, other City bylaws, and approved budgets.
- Value limits apply to certain day-to-day agreements (for example, up to $500,000 when executed by the City Manager and Director of Finance acting together).
