A $213,507.88 legal bill: what the City’s records show, and the question nobody has answered

October 2, 2026. Advance voting in Delta starts October 3. The general election is October 17. This post sets out what City records confirm, what has been reported, and what has not been explained. It does not allege wrongdoing.

Public money was used. Who authorized payment of the legal costs and any settlement? What was the full public cost?


What the City’s records confirm

On August 18, 2026, DCC Now filed a freedom-of-information request (File 0580-20/2026-167) for aggregate legal-cost figures. The City’s responses of August 24 and 26 confirmed that the litigation has been resolved and formally terminated, and provided these totals. Figures are exclusive of GST.

The City later confirmed the same totals as “plus GST.” It did not provide a GST dollar amount. It said 2026 figures are not yet available, and that no insurance claim was made.

The City withheld the underlying invoices as solicitor-client privileged, and it refused to disclose any settlement amount, citing settlement privilege.

What the lawsuit was about

According to public reporting, Paramjit Singh Grewal, a former City employee, sued the City of Delta and Councillor Dylan Kruger. Reports of the claim say Mr. Grewal was fired on March 21, 2024, in an in-camera council session that Councillor Kruger attended, and allege that Councillor Kruger made defamatory comments about him. The City and Councillor Kruger filed responses denying the allegations. None of the allegations were proven in court. The City says the case has been resolved and formally terminated, without a court judgment on the allegations.

What has been reported about the mayor and Councillor Kruger

The Indo-Canadian Voice (voiceonline.com) reported on October 1, 2026, that Mayor George Harvie told voters, at a Chamber of Commerce forum and again on CBC’s mayoral debate, that he had to hire his own lawyer and file a freedom-of-information request to find out the City’s legal-cost figures. The same report says Councillor Kruger dismissed this as a political stunt. The Delta Optimist also reported, from the September 23 Chamber forum, that Mayor Harvie said he had to hire his own lawyer and file his own FOI, and that Councillor Kruger called the claims a political stunt. DCC Now has not independently transcribed the remarks.

The question that matters

Not knowing the dollar amounts and not approving the decision are two different things. The public record does not show which of these happened:

  • Council approved paying Councillor Kruger’s defence, and any settlement, in a closed meeting.
  • An existing bylaw or policy allowed staff to retain lawyers and pay invoices without a new council vote.
  • Some other process was used that has not yet come to light.

Any of these could explain the reported statement. Only the City’s records can show which one is true.

Why this may have been handled privately

Under section 90 of the Community Charter, councils can meet in closed session to discuss legal advice and litigation. A settlement is often decided that way. A case can also end through a private settlement without a judge’s decision. None of this is improper by itself. It does mean the public cannot tell from open agendas and minutes who decided what. That is why the authorizing records matter.

What we have already asked for

On August 29, 2026, DCC Now filed a request for review with the Office of the Information and Privacy Commissioner, limited to the total settlement amount. That review cites Order F15-31, in which an adjudicator ordered the City of Richmond to disclose aggregate legal fees and a settlement total. The City of Richmond sought judicial review of that order. The Delta review is open. This post does not say the order forces Delta to disclose.

Questions for the mayor, council, and all mayoral candidates

  1. What bylaw or resolution authorized the City to pay for Councillor Kruger’s legal defence, and on what date?
  2. What bylaw or resolution authorized any settlement, and on what date?
  3. Was any settlement approved by a council vote? If so, how did each member vote?
  4. If it was approved by staff under delegated authority, who approved it and under which bylaw or policy?
  5. Did the mayor take part in any closed-meeting discussion or vote on a settlement or on paying Councillor Kruger’s legal costs? If not, what rule or reason applied?

If the City says closed-meeting details are confidential, we ask it to confirm in writing who made the decision and how it was recorded, and to name the legal section it relies on for anything it withholds.

Records we are requesting

  • Delta’s bylaw or policy on indemnifying council members and employees.
  • The resolution authorizing payment of Councillor Kruger’s defence costs, with its date and the recorded vote, if one exists.
  • Any resolution retaining Alexander Holburn Beaudin & Lang for Councillor Kruger, and who authorized it.
  • Any record of those items being released from a closed meeting.

2 ਅਕਤੂਬਰ, 2026। ਡੈਲਟਾ ਵਿੱਚ ਅਗਾਊਂ ਵੋਟਿੰਗ 3 ਅਕਤੂਬਰ ਤੋਂ ਸ਼ੁਰੂ ਹੁੰਦੀ ਹੈ। ਆਮ ਚੋਣਾਂ 17 ਅਕਤੂਬਰ ਨੂੰ ਹਨ। ਇਹ ਪੋਸਟ ਦੱਸਦੀ ਹੈ ਕਿ ਸਿਟੀ ਦੇ ਰਿਕਾਰਡ ਕੀ ਪੁਸ਼ਟੀ ਕਰਦੇ ਹਨ, ਕੀ ਰਿਪੋਰਟ ਹੋਇਆ ਹੈ ਅਤੇ ਕਿਸ ਗੱਲ ਦੀ ਵਿਆਖਿਆ ਨਹੀਂ ਹੋਈ। ਇਹ ਕਿਸੇ ਗਲਤ ਕੰਮ ਦਾ ਦੋਸ਼ ਨਹੀਂ ਲਗਾਉਂਦੀ।

ਜਨਤਾ ਦਾ ਪੈਸਾ ਵਰਤਿਆ ਗਿਆ। ਕਾਨੂੰਨੀ ਖਰਚਿਆਂ ਅਤੇ ਕਿਸੇ ਵੀ ਸਮਝੌਤੇ ਦੀ ਰਕਮ ਦਾ ਭੁਗਤਾਨ ਕਿਸ ਨੇ ਮਨਜ਼ੂਰ ਕੀਤਾ? ਜਨਤਾ ਉੱਤੇ ਕੁੱਲ ਖਰਚਾ ਕਿੰਨਾ ਪਿਆ?


ਸਿਟੀ ਦੇ ਰਿਕਾਰਡ ਕੀ ਪੁਸ਼ਟੀ ਕਰਦੇ ਹਨ

18 ਅਗਸਤ, 2026 ਨੂੰ DCC Now ਨੇ ਕੁੱਲ ਕਾਨੂੰਨੀ ਖਰਚਿਆਂ ਦੇ ਅੰਕੜਿਆਂ ਲਈ ਸੂਚਨਾ ਦੀ ਆਜ਼ਾਦੀ ਅਧੀਨ ਬੇਨਤੀ (ਫਾਈਲ 0580-20/2026-167) ਦਾਖ਼ਲ ਕੀਤੀ। ਸਿਟੀ ਦੇ 24 ਅਤੇ 26 ਅਗਸਤ ਦੇ ਜਵਾਬਾਂ ਨੇ ਪੁਸ਼ਟੀ ਕੀਤੀ ਕਿ ਮੁਕੱਦਮੇ ਦਾ ਨਿਪਟਾਰਾ ਹੋ ਚੁੱਕਾ ਹੈ ਅਤੇ ਉਹ ਰਸਮੀ ਤੌਰ ਉੱਤੇ ਖਤਮ ਹੋ ਗਿਆ ਹੈ, ਅਤੇ ਇਹ ਕੁੱਲ ਰਕਮਾਂ ਦਿੱਤੀਆਂ। ਇਨ੍ਹਾਂ ਅੰਕੜਿਆਂ ਵਿੱਚ GST ਸ਼ਾਮਲ ਨਹੀਂ ਹੈ।

ਸਿਟੀ ਨੇ ਬਾਅਦ ਵਿੱਚ ਇਹੋ ਕੁੱਲ ਰਕਮਾਂ “GST ਵੱਖਰਾ” ਕਹਿ ਕੇ ਪੁਸ਼ਟੀ ਕੀਤੀਆਂ। ਉਸ ਨੇ GST ਦੀ ਡਾਲਰ ਰਕਮ ਨਹੀਂ ਦਿੱਤੀ। ਉਸ ਨੇ ਕਿਹਾ ਕਿ 2026 ਦੇ ਅੰਕੜੇ ਹਾਲੇ ਉਪਲਬਧ ਨਹੀਂ ਹਨ ਅਤੇ ਕੋਈ ਬੀਮਾ ਦਾਅਵਾ ਨਹੀਂ ਕੀਤਾ ਗਿਆ ਸੀ।

ਸਿਟੀ ਨੇ ਵਕੀਲ ਅਤੇ ਮੁਵੱਕਲ ਵਿਚਕਾਰ ਗੋਪਨੀਯਤਾ ਦੇ ਕਾਨੂੰਨੀ ਵਿਸ਼ੇਸ਼ ਅਧਿਕਾਰ ਦਾ ਹਵਾਲਾ ਦੇ ਕੇ ਮੂਲ ਇਨਵੌਇਸ ਰੋਕੇ, ਅਤੇ ਸਮਝੌਤੇ ਦੀ ਗੋਪਨੀਯਤਾ ਦੇ ਵਿਸ਼ੇਸ਼ ਅਧਿਕਾਰ ਦਾ ਹਵਾਲਾ ਦੇ ਕੇ ਕਿਸੇ ਵੀ ਸਮਝੌਤੇ ਦੀ ਰਕਮ ਦੱਸਣ ਤੋਂ ਇਨਕਾਰ ਕੀਤਾ।

ਮੁਕੱਦਮਾ ਕਿਸ ਬਾਰੇ ਸੀ

ਜਨਤਕ ਰਿਪੋਰਟਾਂ ਮੁਤਾਬਕ, ਸਿਟੀ ਦੇ ਸਾਬਕਾ ਕਰਮਚਾਰੀ ਪਰਮਜੀਤ ਸਿੰਘ ਗਰੇਵਾਲ ਨੇ ਸਿਟੀ ਆਫ਼ ਡੈਲਟਾ ਅਤੇ ਕੌਂਸਲਰ ਡਿਲਨ ਕ੍ਰੂਗਰ ਵਿਰੁੱਧ ਮੁਕੱਦਮਾ ਕੀਤਾ। ਦਾਅਵੇ ਬਾਰੇ ਰਿਪੋਰਟਾਂ ਕਹਿੰਦੀਆਂ ਹਨ ਕਿ ਸ੍ਰੀ ਗਰੇਵਾਲ ਨੂੰ 21 ਮਾਰਚ, 2024 ਨੂੰ ਕੌਂਸਲ ਦੀ ਇੱਕ ਬੰਦ ਮੀਟਿੰਗ ਵਿੱਚ ਨੌਕਰੀ ਤੋਂ ਕੱਢਿਆ ਗਿਆ, ਜਿਸ ਵਿੱਚ ਕੌਂਸਲਰ ਕ੍ਰੂਗਰ ਹਾਜ਼ਰ ਸਨ, ਅਤੇ ਦੋਸ਼ ਲਗਾਇਆ ਗਿਆ ਕਿ ਕੌਂਸਲਰ ਕ੍ਰੂਗਰ ਨੇ ਉਨ੍ਹਾਂ ਬਾਰੇ ਮਾਣਹਾਨੀ ਵਾਲੀਆਂ ਟਿੱਪਣੀਆਂ ਕੀਤੀਆਂ। ਸਿਟੀ ਅਤੇ ਕੌਂਸਲਰ ਕ੍ਰੂਗਰ ਨੇ ਜਵਾਬ ਦਾਖ਼ਲ ਕਰਕੇ ਦੋਸ਼ਾਂ ਤੋਂ ਇਨਕਾਰ ਕੀਤਾ। ਕੋਈ ਵੀ ਦੋਸ਼ ਅਦਾਲਤ ਵਿੱਚ ਸਾਬਤ ਨਹੀਂ ਹੋਇਆ। ਸਿਟੀ ਕਹਿੰਦੀ ਹੈ ਕਿ ਦੋਸ਼ਾਂ ਉੱਤੇ ਅਦਾਲਤੀ ਫੈਸਲੇ ਤੋਂ ਬਿਨਾਂ ਮਾਮਲੇ ਦਾ ਨਿਪਟਾਰਾ ਹੋ ਗਿਆ ਹੈ ਅਤੇ ਉਹ ਰਸਮੀ ਤੌਰ ਉੱਤੇ ਖਤਮ ਹੋ ਗਿਆ ਹੈ।

ਮੇਅਰ ਅਤੇ ਕੌਂਸਲਰ ਕ੍ਰੂਗਰ ਬਾਰੇ ਕੀ ਰਿਪੋਰਟ ਹੋਇਆ ਹੈ

ਇੰਡੋ-ਕੈਨੇਡੀਅਨ ਵੌਇਸ (voiceonline.com) ਨੇ 1 ਅਕਤੂਬਰ, 2026 ਨੂੰ ਰਿਪੋਰਟ ਕੀਤਾ ਕਿ ਮੇਅਰ ਜਾਰਜ ਹਾਰਵੀ ਨੇ ਚੈਂਬਰ ਆਫ਼ ਕਾਮਰਸ ਦੇ ਫੋਰਮ ਅਤੇ ਫਿਰ CBC ਦੀ ਮੇਅਰ ਉਮੀਦਵਾਰਾਂ ਦੀ ਬਹਿਸ ਵਿੱਚ ਵੋਟਰਾਂ ਨੂੰ ਦੱਸਿਆ ਕਿ ਸਿਟੀ ਦੇ ਕਾਨੂੰਨੀ ਖਰਚਿਆਂ ਦੇ ਅੰਕੜੇ ਜਾਣਨ ਲਈ ਉਨ੍ਹਾਂ ਨੂੰ ਆਪਣਾ ਵਕੀਲ ਰੱਖਣਾ ਅਤੇ ਸੂਚਨਾ ਦੀ ਆਜ਼ਾਦੀ ਅਧੀਨ ਬੇਨਤੀ ਦਾਖ਼ਲ ਕਰਨੀ ਪਈ। ਉਸੇ ਰਿਪੋਰਟ ਮੁਤਾਬਕ ਕੌਂਸਲਰ ਕ੍ਰੂਗਰ ਨੇ ਇਸ ਨੂੰ ਸਿਆਸੀ ਸਟੰਟ ਕਹਿ ਕੇ ਰੱਦ ਕੀਤਾ। ਡੈਲਟਾ ਔਪਟਿਮਿਸਟ ਨੇ ਵੀ 23 ਸਤੰਬਰ ਦੇ ਚੈਂਬਰ ਫੋਰਮ ਬਾਰੇ ਰਿਪੋਰਟ ਕੀਤਾ ਕਿ ਮੇਅਰ ਹਾਰਵੀ ਨੇ ਆਪਣਾ ਵਕੀਲ ਰੱਖਣ ਅਤੇ ਆਪਣੀ FOI ਬੇਨਤੀ ਦਾਖ਼ਲ ਕਰਨ ਦੀ ਗੱਲ ਕਹੀ, ਅਤੇ ਕੌਂਸਲਰ ਕ੍ਰੂਗਰ ਨੇ ਇਨ੍ਹਾਂ ਦਾਅਵਿਆਂ ਨੂੰ ਸਿਆਸੀ ਸਟੰਟ ਕਿਹਾ। DCC Now ਨੇ ਇਨ੍ਹਾਂ ਟਿੱਪਣੀਆਂ ਦੀ ਸੁਤੰਤਰ ਤੌਰ ਉੱਤੇ ਸ਼ਬਦ-ਬ-ਸ਼ਬਦ ਲਿਖਤ ਤਿਆਰ ਨਹੀਂ ਕੀਤੀ।

ਅਹਿਮ ਸਵਾਲ

ਡਾਲਰ ਰਕਮਾਂ ਦਾ ਪਤਾ ਨਾ ਹੋਣਾ ਅਤੇ ਫੈਸਲੇ ਨੂੰ ਮਨਜ਼ੂਰੀ ਨਾ ਦੇਣਾ ਦੋ ਵੱਖਰੀਆਂ ਗੱਲਾਂ ਹਨ। ਜਨਤਕ ਰਿਕਾਰਡ ਇਹ ਨਹੀਂ ਦੱਸਦਾ ਕਿ ਇਨ੍ਹਾਂ ਵਿੱਚੋਂ ਕੀ ਹੋਇਆ:

  • ਕੌਂਸਲ ਨੇ ਬੰਦ ਮੀਟਿੰਗ ਵਿੱਚ ਕੌਂਸਲਰ ਕ੍ਰੂਗਰ ਦੀ ਕਾਨੂੰਨੀ ਪੈਰਵੀ ਅਤੇ ਕਿਸੇ ਵੀ ਸਮਝੌਤੇ ਦੀ ਰਕਮ ਦਾ ਭੁਗਤਾਨ ਮਨਜ਼ੂਰ ਕੀਤਾ।
  • ਕਿਸੇ ਮੌਜੂਦਾ ਉਪਨਿਯਮ ਜਾਂ ਨੀਤੀ ਨੇ ਸਟਾਫ਼ ਨੂੰ ਕੌਂਸਲ ਦੀ ਨਵੀਂ ਵੋਟ ਤੋਂ ਬਿਨਾਂ ਵਕੀਲ ਰੱਖਣ ਅਤੇ ਇਨਵੌਇਸਾਂ ਦਾ ਭੁਗਤਾਨ ਕਰਨ ਦੀ ਇਜਾਜ਼ਤ ਦਿੱਤੀ।
  • ਕੋਈ ਹੋਰ ਪ੍ਰਕਿਰਿਆ ਵਰਤੀ ਗਈ ਜੋ ਹਾਲੇ ਸਾਹਮਣੇ ਨਹੀਂ ਆਈ।

ਇਨ੍ਹਾਂ ਵਿੱਚੋਂ ਕੋਈ ਵੀ ਗੱਲ ਰਿਪੋਰਟ ਕੀਤੇ ਬਿਆਨ ਦੀ ਵਿਆਖਿਆ ਕਰ ਸਕਦੀ ਹੈ। ਸਿਰਫ਼ ਸਿਟੀ ਦੇ ਰਿਕਾਰਡ ਦੱਸ ਸਕਦੇ ਹਨ ਕਿ ਕਿਹੜੀ ਗੱਲ ਸੱਚ ਹੈ।

ਇਸ ਮਾਮਲੇ ਨੂੰ ਬੰਦ ਮੀਟਿੰਗ ਵਿੱਚ ਕਿਉਂ ਨਿਪਟਾਇਆ ਗਿਆ ਹੋ ਸਕਦਾ ਹੈ

ਕਮਿਊਨਿਟੀ ਚਾਰਟਰ ਦੀ ਧਾਰਾ 90 ਅਧੀਨ ਕੌਂਸਲਾਂ ਕਾਨੂੰਨੀ ਸਲਾਹ ਅਤੇ ਮੁਕੱਦਮੇਬਾਜ਼ੀ ਬਾਰੇ ਚਰਚਾ ਲਈ ਬੰਦ ਮੀਟਿੰਗ ਕਰ ਸਕਦੀਆਂ ਹਨ। ਸਮਝੌਤੇ ਦਾ ਫੈਸਲਾ ਅਕਸਰ ਇਸੇ ਤਰ੍ਹਾਂ ਹੁੰਦਾ ਹੈ। ਕੋਈ ਮਾਮਲਾ ਜੱਜ ਦੇ ਫੈਸਲੇ ਤੋਂ ਬਿਨਾਂ ਨਿੱਜੀ ਸਮਝੌਤੇ ਰਾਹੀਂ ਵੀ ਖਤਮ ਹੋ ਸਕਦਾ ਹੈ। ਇਹ ਆਪਣੇ ਆਪ ਵਿੱਚ ਗਲਤ ਨਹੀਂ ਹੈ। ਪਰ ਇਸ ਦਾ ਮਤਲਬ ਹੈ ਕਿ ਜਨਤਾ ਖੁੱਲ੍ਹੇ ਏਜੰਡਿਆਂ ਅਤੇ ਕਾਰਵਾਈ ਦੇ ਰਿਕਾਰਡ ਤੋਂ ਨਹੀਂ ਜਾਣ ਸਕਦੀ ਕਿ ਕਿਸ ਨੇ ਕੀ ਫੈਸਲਾ ਕੀਤਾ। ਇਸੇ ਲਈ ਮਨਜ਼ੂਰੀ ਦੇ ਰਿਕਾਰਡ ਅਹਿਮ ਹਨ।

ਅਸੀਂ ਪਹਿਲਾਂ ਹੀ ਕੀ ਮੰਗਿਆ ਹੈ
